1. Acceptance of Terms

By accessing and using Unseen (the "App"), you accept and agree to be bound by the terms and provisions of this agreement. These Terms apply to all visitors and users who access or use the App. If you disagree with any part of these terms, then you may not access the App.

2. Description of Service

Unseen is a free, educational iOS application designed to raise awareness about digital accessibility by simulating how people with different visual impairments experience digital interfaces.

The App provides four simulation modes:

• Color Blindness: Experience protanopia, deuteranopia, and tritanopia simulations
• Blurred Vision: Understand visual impairment through blur effects
• Cataracts: See how cataracts affect digital content perception
• Low Contrast: Experience difficulty with poor color contrast

The App is 100% free, offline-first, and collects ZERO personal data. It is built for educational purposes to promote inclusive design.

3. No Data Collection

Unseen does NOT require user accounts, sign-in, or sign-up. The App operates completely offline and does not collect, store, transmit, or share any personal information.

4. Free Service

Unseen is provided completely free of charge. There are no subscriptions, in-app purchases, advertisements, or hidden fees.

All features are available to all users at no cost. We believe accessibility education should be freely accessible to everyone.

5. Age Requirements and COPPA Compliance

Our App is rated 4+ and suitable for all ages, including children under 13. Because we collect ZERO data, we are 100% compliant with the Children's Online Privacy Protection Act (COPPA) and similar laws worldwide.

No parental consent is required as no personal information is collected, stored, or transmitted.

6. Educational Purpose

Unseen is designed for educational purposes to help designers, developers, and the general public understand accessibility challenges.

The simulations provided are approximations and may not perfectly represent every individual's experience with visual impairments. The App should not be used as a medical diagnostic tool.

7. Prohibited Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use the App to develop a competing service
• Interfere with or disrupt the integrity or performance of the App
• Attempt to gain unauthorized access to the App or its related systems
• Redistribute or resell the App without permission

8. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Unseen and its developer. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. UNSEEN DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNSEEN AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (ii) ANY CONTENT OBTAINED FROM THE APP; AND (iii) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR DEVICE OR CONTENT.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will provide notice through the App or on this website. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
